These Terms of Conditions (“Terms”) govern your use of www.bravegeneration.org and related online services operated by Brave Generation Inc., a U.S. 501(c)(3) nonprofit. By using the site, you agree to these Terms and our Privacy Policy.
Agreement to these Terms
If you do not agree to these Terms, please do not use the website. We may update these Terms from time to time; the “Last updated” date at the top of this page will change when we do. Continued use after updates constitutes acceptance of the revised Terms.
Who operates this website?
Brave Generation Inc. is a United States public charity under Internal Revenue Code section 501(c)(3), EIN 93-1717971. We are headquartered in association with New York, NY, United States, and run education, mentorship, and leadership programs for Ukrainian youth.
Nothing on this website creates a partnership, employment, or agency relationship between you and Brave Generation unless we enter a separate written agreement.
Acceptable use of the website
You agree to use the site only for lawful purposes. You must not:
- Attempt to disrupt, scrape abusively, or gain unauthorized access to the site or systems
- Submit false or misleading information through forms
- Use automated means to overload forms (we use Cloudflare Turnstile to help prevent abuse)
- Misrepresent an affiliation with Brave Generation
- Use site content in a way that violates these Terms or applicable law
We may suspend or restrict access if we reasonably believe these Terms are being violated.
Donations and payments
Donations made through the site are voluntary gifts to support our charitable mission. Online payments are processed by Stripe. By donating, you also agree to Stripe’s applicable terms for the payment method you use.
- Donations are generally non-refundable, except where required by law or where we agree in writing to a correction of an obvious error.
- As a 501(c)(3) organization, contributions are tax-deductible to the extent permitted by U.S. law. You are responsible for determining deductibility for your situation; we do not provide tax advice.
- A donation does not purchase goods or services unless we expressly describe a specific benefit in a separate offer.
If you believe a donation was unauthorized or duplicated in error, contact [email protected] promptly so we can review it with our payment processor.
Programs, applications, and site content
Information about fellowships, internships, mentorship, and other programs is provided for general informational purposes. Program eligibility, timelines, and benefits may change. Submitting a newsletter form or browsing the site does not enroll you in a program.
Participant stories, statistics, and media may be illustrative. Where we display Instagram content via Meta’s API, that content remains subject to Instagram/Meta rules and our rights as the publishing account.
Third-party services
The site relies on third-party services, including without limitation:
- Stripe — donation checkout and payment processing
- Meta / Instagram Graph API — display of our public Instagram posts
- Cloudflare Turnstile — bot protection on forms
- Brevo — email delivery related to newsletter submissions
- Google Analytics and Microsoft Clarity — analytics
Those services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services we do not control, including links we provide for convenience.
Intellectual property
Unless otherwise noted, text, branding, logos, layout, and original media on this website are owned by Brave Generation Inc. or used with permission. You may share links to public pages and quote brief excerpts for non-commercial news or educational purposes with attribution. You may not copy the site wholesale, scrape content for competing services, or use our marks in a way that suggests endorsement without written permission.
Disclaimers
The website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
Educational and program information is not legal, medical, immigration, or financial advice.
Limitation of liability
To the fullest extent permitted by applicable law, Brave Generation Inc. and its directors, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the site or inability to use it. Our aggregate liability for claims relating to the site will not exceed the greater of (a) the amount you donated through the site in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited by law.
Governing law
These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules that would require another jurisdiction’s law. Courts located in New York, New York, will have exclusive jurisdiction over disputes arising from these Terms or the website, except where prohibited by law.
Changes to the site or Terms
We may modify or discontinue any part of the website at any time. We may also revise these Terms; material changes will be reflected by updating the date on this page. Your continued use after changes means you accept the updated Terms.
